If my daughters father hasnt seen her in almost a year can i get his rights taken away?

My daughter's father has not seen her since her 1st birthday and she just turned 2 on the 27th of June. I was told that i could get his rights taken, the reason why i ask is because my Fiance is a great man and takes care of her and I and that is who she calls daddy. She loves him to death and he loves her. So i really need some serious help. I called a lawyers office but they want to make me pay for a consultation on the phone. :( PLEASE HELP!!!
