Has anyone or know anyone who is a CNA (certified nursing istant) who got in trouble with the DOPH?

a friend of mine received a letter of complaint from department of public health certification investigation unit. His previous employer reported him for misconduct due to... they found out his personal numbers on a patient's celphone. The letter is asking for his statement within 30 days, My question is what if don't give his response and his company's allegation has merit, could he lose his certificate or license?
